At Jibespot Inc (“Jibespot”), we are committed to maintaining the accuracy, confidentiality and security of your personal information. We have developed this Privacy Policy to describe our specific privacy policies and practices and how we collect, use and disclose the personal information of those individuals who use our application. We have developed other documents that describe our privacy policies and practices with respect to those individuals with whom we interact.

Privacy Policy Effective for Canada

It is Jibespot’s policy to comply with the privacy legislation within each jurisdiction in which we operate. Sometimes the privacy legislation and/or an individual's right to privacy are different from one jurisdiction to another. This Privacy Policy covers only those activities that are subject to the provisions of Canada's federal and provincial privacy laws, as applicable.

This Privacy Policy has a limited scope and application. Consequently, the rights and obligations contained in this Privacy Policy may not be available to all individuals or in all jurisdictions. If you are unsure if or how this Privacy Policy applies to you, please contact our Compliance Team for more information.

What Is Personal Information?

For the purposes of this Privacy Policy, personal information is any information about an identifiable individual, other than the person's business title or business contact information when used or disclosed for the purpose of business communications.

Why Do We Collect, Use and Disclose Personal Information?

The personal information collected is used and disclosed for our business purposes.

Your personal information may be shared with our employees, contractors, consultants, affiliates and other parties who require such information to assist us with establishing, maintaining and managing our services and relationship with you. In addition, personal information may be disclosed or transferred to another party in the event of a change in ownership of, or a grant of a security interest in, all or a part of Jibespot.

We may collect, use or disclose your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so.

What Information Do We Collect and How Do We Use Such Information?

Use of our application will result in the collection of information related to your use of our application, including:

When you sign up for an account

• Your username.
• Your email address.
• Your birthdate.
• If you chose to submit it, your display name.
• If you chose to submit it, your gender.
• If you chose to submit it, your profile picture.
• If you chose to submit it, a short biographical paragraph.

Your gender, if you provide such information, and birthdate may be used to identify content that you may find of interest and may assist in the provision of user catered advertising. Your display name, profile picture, and biographical paragraph if you chose to provide them along with your username will be visible to other users of Jibespot.

When users create a post or comment

Users may choose to share photos, video and text on Jibespot with other Jibespot users in the form of posts and comments. Users have the option to delete any post or comment they create. However, deleted content may survive on our servers for a period of time until deleted from the drive.

Jibespot requests access to users’ phone camera so that a user may capture videos and pictures. Users may decline such request.

Jibespot requests access to users’ phone microphone so that any videos captured may capture corresponding sound. Users may decline such request if declining camera access.

Jibespot requests access to users’ phone media if a user wishes to upload a video or picture for sharing on Jibespot. Users may decline such request.

Jibespot asks users for permission to send them notification alerts for items such as new ‘Jibes’ and comments on their posts and @mentions and similar notifications. If accepted, Apple sends Jibespot the user’s phone device token so that Jibespot can send notifications to that device. Users may decline such request.

All content that is posted is scanned by Jibespot servers for the following:

• To determine if the content is adult content.
  
  If such content is adult content and is of an artistic nature and is not pornographic in intent, a blurred censor may be placed over the post when viewable on Jibespot with an adult content warning. Users must tap their device screen to view the content.
  
  If such content is of a pornographic and non-artistic nature (such as nudity with additional sexual innuendo), as determined at the sole discretion of Jibespot, the content may be blocked by Jibespot’s compliance team and the user attempting to post the content is sent a compliance email stating that they have violated our Terms of Use.
• To determine if the content is of a violent nature.
  
  Graphic violent acts towards living beings used for information sake such as for enhancing news may have a blurred censor placed over the post when viewable on Jibespot with a graphic content warning. Users must tap their device screen to view the content.
  
  Violence (physical or implied) that is being glorified or is at the sole discretion of Jibespot determined to be distasteful may be blocked at the sole discretion of Jibespot’s compliance team. In such an event, the user attempting to post such content will be sent a compliance email stating that they have violated our Terms of Use.
• To determine if the content is medical content (such as gore or the contents of living beings).
  
  Medical content used for information sake such as for enhancing news may have a blurred censor placed over such content with a graphic content warning. Users must tap their device screens to view such content.
  
  Any medical content that at the sole discretion of Jibespot is determined to be being glorified or distasteful may be blocked at the discretion of our compliance team, in which event the user that attempted to post such content will be sent a compliance email stating that they have violated our Terms of Use.
• To determine if the content is spoof content, such as memes, Photoshopped content, and not real images. Such information may additionally be utilized to assess whether content is untruthful, misleading or “fake news” content as well as the reputation of the posting user.
• To determine the sentiment of text content. Such information may be utilized to identify content that a user may find of interest.
• To understand the nature of the content, such as its subject matter. Such information is used to assist Jibespot in identifying which users would have an interest in such content and make such content available to such users.
  
  When users ‘Jibe’ with content in order to tell Jibespot that they want to keep seeing content of this nature, and ‘Skip’ content if they are not so interested, Jibespot retains the choice made by a user. Jibespot uses this information to identify content that you may find of interest and may also use this information to make available to users catered advertising.

Additional Data Collected

Additional data is collected and retained by Jibespot. Such data is:

• The approximate estimated public location (city, country, region, latitude, longitude) of the public IP address the user’s phone which connects to and uses to make requests to our servers to log in, post, etc. Such information is provided by the Internet Service Provider that owns this public IP address and is made publicly available through their data feeds according to a public specification [1]. Such information may be used to assist Jibespot to identify optimal content for a user and to make such content available to such user. Such information may be utilized by Jibespot to show the user catered advertising.
• The primary language setting of a user’s phone. Such information may be used to translate the languages of posts automatically for other users.
• The point on the screen where the user swipes ‘UP’ in the feed on a specific post to progress to the next post in the feed. Such information is utilized to identify whether a user has ‘Jibed’ or skipped a specific post.

We may also collect information to monitor our application’s performance (e.g., number of visits, average time spent) for use for our business purposes such as working to continually upgrade our application.

In addition, we collect the personal information that you submit to our application, such as your username, email address and any other contact or other information that you choose to provide during sign up and in the user settings page.

Where you request information from us, we may use the email address that you provide to send you information about content posted on Jibespot that we believe may be of interest to you. If we send you information by email, you may ask us to remove you from the email list at any time (using the unsubscribe instructions provided with each email). If you have asked us to put you on an email mailing list to provide you with certain information on a regular basis, or if we send you information about our offers on products and services by email, you may ask us to remove you from the list at any time (using the unsubscribe instructions provided with each email).

What About Links to Third Party Websites?

Our application may contain links to third party websites that may be subject to less stringent privacy standards. We cannot assume any responsibility for the privacy practices, policies or actions of the third parties that operate these websites. Jibespot is not responsible for how such third parties collect, use or disclose your personal information. You should review the privacy policies of these websites before providing them with personal information.

Your Consent Is Important to Us

By using our application, we assume that you have consented to the collection, use and disclosure of your personal information as explained in this Privacy Policy.

You may change or withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice, by contacting our Compliance Team using the contact information set out below. All communications with respect to such withdrawal or variation of consent should be in writing and addressed to our Compliance Team. Due to the nature of our account formation process, the fact that our application does not have anonymous accounts and the kinds of information we require to create an account, if you do choose to withdraw your consent to this Privacy Policy, which it is your right to do, your account will be terminated or suspended.

How Is Your Personal Information Protected?

Jibespot endeavours to maintain physical, technical and procedural safeguards that are appropriate to the sensitivity of the personal information in question. These safeguards are designed to prevent your personal information from loss and unauthorized access, copying, use, modification or disclosure.

All data collected is encrypted on our servers. This is a service provided by our host provider Google. If we change service providers in the future we will continue to keep data safe with encryption. In addition, we have our own password encryption that we perform in addition to the encryption provided by our host provider. This means that user passwords are encrypted twice for safety.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while this application strives to protect your personal information, we cannot warrant the security of any information you transmit to us, and you do so at your own risk. Once this application or Jibespot receives your transmission, we make commercially reasonable efforts to ensure its security on our systems.

Law Enforcement Requests

We will disclose personal information without your knowledge or consent if we receive an order, subpoena, warrant or other legal requirement issued by a court, tribunal, regulator or other person with jurisdiction to compel disclosure of your personal information. If we receive a request from a police officer or other law enforcement agency for access to your personal information in the course of an actual or potential investigation, our policy is to require the police officer or law enforcement agency to obtain an order, subpoena or warrant, unless the information is urgently required to prevent serious bodily injury or serious damage to personal property. If we receive a written request from a police officer or other law enforcement agency with authority to request access to your personal information in the course of an actual or potential investigation into a breach of a law, our policy is to provide the requested information.

Updating Your Personal Information

It is important that the information contained in our records is both accurate and current. If your personal information happens to change during the course of our relationship, please keep us informed of such changes.

In some circumstances, we may not agree with your request to change your personal information and will instead append an alternative text to the record in question.

Access to Your Personal Information

You can ask to see the personal information that we hold about you. If you want to review, verify or correct your personal information, please contact our Compliance Team using the contact information set out below. Please note that any such communication must be in writing.

Interpretation of this Privacy Policy

Any interpretation associated with this Privacy Policy will be made by our Compliance Team. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples; therefore, where the word "including" is used, it shall mean "including without limitation".

This Privacy Policy does not create or confer upon any individual any rights, or impose upon Jibespot any obligations outside of, or in addition to, any rights or obligations imposed by Canada's federal and provincial privacy laws, as applicable.
